I Have Over The Years Handled Significant Litigation In State, Federal And Administrative Tribunals And Have Extensive Experience In ADR Techniques Including Mediation And Arbitration.
Extensive Experience in Arbitration and Mediation
Both arbitration and mediation as a part of the alternative dispute resolution revolution have become an important part of the construction industry. Beginning with the establishment of the American Arbitration Association's Construction Industry Rules, I have taken part in many arbitrations and mediations for owner's, contractors, Architects, engineers, suppliers and construction surety companies. I have been a member of the American Arbitration Associations Construction Panel of Arbitrators for a number of years.
Contract Drafting and Review
I have had extensive experience in drafting and review construction contracts in both the private and governmental arenas, concerning fixed priced, design/build, unit price, construction management and cost plus contracts. These contracts range from the simplest subcontract agreement, to major commercial construction contracts.
Contract Claims
I have had extensive experience in both prosecuting and defending construction claims on residential, commercial, state and federal projects. I have dealt with a number types of claims both prosecuting and defending that include: handling delay and acceleration claims; differing site conditions; loss of productivity and cost overrun claims; and defective construction claims. I have the technological expertise to deal with claim documentation in traditional paper form and electronic form and to analyze and thoroughly document construction claims.
